Introduction

Craftisan Labs LTD respects the intellectual property rights of others and expects users of DeepSleep Ai to do the same. This Digital Millennium Copyright Act (DMCA) Policy outlines our procedures for responding to claims of copyright infringement in accordance with the DMCA (17 U.S.C. § 512) and similar applicable laws.

If you believe that content available through DeepSleep Ai infringes upon your copyrighted work, please follow the procedure described below to submit a formal DMCA takedown notice.

1. Reporting Copyright Infringement (DMCA Takedown Notice)

If you are a copyright owner or an authorized agent and believe that your copyrighted work has been used on DeepSleep Ai in a way that constitutes copyright infringement, you may submit a written DMCA Notice to our designated agent.

Your DMCA Notice Must Include ALL of the Following:

  1. Identification of the copyrighted work: A clear description of the copyrighted work you claim has been infringed. If multiple works are covered under a single notice, you may provide a representative list.
  2. Identification of the infringing material: A specific and detailed description of the material you claim is infringing, including the exact location (URL, screen name, feature, or section within the App) where the allegedly infringing material can be found.
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  4. A statement of good faith belief: A declaration that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy: A declaration, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Your electronic or physical signature: The notice must be signed (physically or electronically) by the copyright owner or their authorized representative.

2. Where to Send Your DMCA Notice

We strongly recommend sending your notice via email to ensure the fastest possible response. Incomplete notices will not be processed.

3. Our Response to DMCA Notices

Upon receipt of a valid and complete DMCA Notice, Craftisan Labs LTD will:

  • Acknowledge receipt of your notice within 14 business days
  • Promptly investigate the claim
  • Remove or disable access to the allegedly infringing content if the claim is substantiated
  • Notify the user responsible for the content, where applicable
  • Document the claim in accordance with our repeat infringer policy

We reserve the right to make all final determinations regarding the validity of DMCA claims.

4. Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a written Counter-Notification to our designated agent.

Your Counter-Notification Must Include:

  • Identification of the removed content: A description of the material that was removed and its former location within the App or website.
  • Your contact information: Your full legal name, mailing address, telephone number, and email address.
  • A statement of good faith belief: A declaration, under penalty of perjury, that you have a good faith belief the material was removed as a result of a mistake or misidentification.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of a Federal District Court in your district (or, if outside the United States, any judicial district in which Craftisan Labs LTD may be found), and that you will accept service of process from the party who submitted the original DMCA Notice.
  • Your signature: Physical or electronic signature.

Upon receipt of a valid Counter-Notification, we will forward it to the original complainant and reinstate the content within 10–14 business days, unless the copyright claimant files a court action to restrain the alleged infringement.

5. Repeat Infringer Policy

Craftisan Labs LTD maintains a strict repeat infringer policy. In accordance with the DMCA, we will terminate the accounts of users who are determined to be repeat infringers of intellectual property rights.

A "repeat infringer" is any user whose content is the subject of more than one valid DMCA takedown notice within a 12-month period, or who otherwise demonstrates a pattern of infringing behavior.

Account termination under this policy is at the sole discretion of Craftisan Labs LTD and may occur without prior warning.

6. Abuse of the DMCA Process

We take the abuse of the DMCA process seriously. Submitting a DMCA Notice with the knowledge that it contains materially false information constitutes perjury under U.S. law and may expose you to civil liability, including costs and attorney's fees.

If we determine that a DMCA Notice was submitted in bad faith or constitutes an abuse of the process, we reserve the right to take appropriate legal action.

7. Intellectual Property Ownership

All original content created by Craftisan Labs LTD for DeepSleep Ai — including but not limited to soundscapes, guided meditations, sleep stories, branding, software, and AI systems — is the exclusive intellectual property of Craftisan Labs LTD and is protected by applicable copyright and trademark law.

Any unauthorized reproduction, distribution, or use of our content may result in legal action.

8. Changes to This DMCA Policy

We may update this DMCA Policy from time to time. Updates will be reflected by revising the "Last Updated" date at the top of this page. Continued use of the Service constitutes acceptance of any updated policy.
